Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Fluxpay, the payments platform available at fluxpaywave.com. By creating an account or using our APIs, you agree to these Terms on behalf of yourself and any organization you represent. If you do not agree, do not use the service.

You must provide accurate information, keep your credentials and API keys confidential, and are responsible for all activity under your account. Notify us promptly of any unauthorized use. You must be legally able to enter into these Terms.

You agree not to use Fluxpay to:

• Process payments for activities that are illegal in your jurisdiction.
• Facilitate fraud, money laundering, or sanctions evasion.
• Circumvent card-network rules or our risk and compliance controls.
• Probe, scan, overload, or disrupt the platform or its infrastructure.
• Resell or expose the API in a way that violates these Terms.

Fees for processing, payouts, and add-on features are described in your pricing plan. Unless stated otherwise, fees are exclusive of taxes, charged in the listed currency, and may be deducted from settlement. We may update pricing with reasonable advance notice.

Fluxpay acts as a payment facilitator and works with card networks, acquiring banks, and other financial partners to move funds. Settlement timing, holds, and reserves may apply based on risk, chargeback exposure, and applicable regulations. You are responsible for refunds, disputes, and chargebacks arising from your transactions.

We work to keep the platform highly available and publish live uptime at status.fluxpaywave.com. The service is provided on an “as is” and “as available” basis, without warranties of any kind except those that cannot be excluded by law.

Fluxpay and its software, documentation, and marks remain our property. We grant you a limited, non-exclusive, non-transferable right to use the API and SDKs to build and operate your integration. You retain ownership of your own application and data.

To the maximum extent permitted by law, Fluxpay will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our aggregate liability for any claim is limited to the fees you paid us in the three months preceding the event giving rise to the claim.

You agree to indemnify and hold Fluxpay harmless from claims arising out of your use of the service, your transactions, or your breach of these Terms, except to the extent caused by our own misconduct.

You may close your account at any time. We may suspend or terminate access if you violate these Terms, create undue risk, or as required by our financial partners or applicable law. On termination, certain provisions — including fees owed and liability limits — survive.

We may update these Terms from time to time. When we make material changes, we will provide notice through the dashboard or by email. Continued use after changes take effect constitutes acceptance.
